Welcome to ZADDY. These Terms of Use (“Terms”) are a binding agreement between you and ZADDY (“ZADDY,” “we,” “our,” or “us”) and govern your access to and use of www.zaddyproducts.com, our products, and our related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Important. ZADDY is not a healthcare provider, pharmacy, or medical group, and we do not practice medicine. We operate a technology platform that connects men with independent, licensed healthcare providers, facilitated through our telehealth partner, OpenLoop Health, Inc., and its affiliated medical groups. Clinical decisions, including whether any treatment or prescription is appropriate, are made solely by a licensed provider. Nothing on the Services is medical advice, and the Services are not a substitute for an in-person examination or emergency care.
Eligibility
You must be at least 18 years old, reside in a U.S. state where we offer the Services, and be able to form a legally binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements and that all information you provide is accurate, current, and complete.
The Services
ZADDY allows you to complete a medical intake, be connected with a licensed provider for evaluation, and, where clinically appropriate, receive a prescription that is filled and shipped by a partner pharmacy. Whether treatment is appropriate is determined solely by the provider. A provider may decline to issue a prescription, and being charged for an evaluation does not guarantee that you will receive a particular medication or treatment.
No Doctor–Patient Relationship With ZADDY
Your provider–patient relationship is exclusively with the independent licensed provider who evaluates and treats you, not with ZADDY. We do not interfere with the professional judgment of any provider. Any questions about your diagnosis, treatment, or medication should be directed to your provider.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. You agree to provide accurate information and to keep it up to date. We may suspend or terminate your account if we believe you have violated these Terms or provided false information.
Subscriptions, Billing & Auto-Renewal
Many ZADDY products are offered on a recurring subscription basis. When you enroll, you authorize us and our payment processors to charge your payment method on a recurring schedule until you cancel. Subscriptions automatically renew at the then-current price unless you cancel before the next billing date.
- Your subscription and billing cycle begin when you submit your intake and your first payment is processed.
- Prices, fees, and the contents of any bundle or plan may change; we will provide notice of material changes as required by law.
- You can manage or cancel your subscription as described in our Refund & Cancellation Policy.
Pricing & Payment
All prices are in U.S. dollars and are exclusive of any applicable taxes unless stated otherwise. You authorize us to charge all fees to the payment method on file. If a charge is declined, we may suspend fulfillment until payment is resolved. We reserve the right to correct pricing errors even after an order has been placed.
Shipping & Prescription Fulfillment
Prescription products are dispensed and shipped only by licensed partner pharmacies after a provider issues a valid prescription. Delivery times are estimates and not guarantees. Title and risk of loss pass to you upon delivery to the carrier. Certain products may require signature or identity verification on delivery.
Acceptable Use
You agree not to:
- Provide false, misleading, or incomplete information during intake or at any time;
- Resell, share, or redistribute any medication or prescription product received through the Services;
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
- Attempt to interfere with, compromise, reverse engineer, or disrupt the Services or their security;
- Infringe the intellectual property or other rights of ZADDY or any third party.
Intellectual Property
The Services and all content, branding, logos, text, graphics, and software are owned by or licensed to ZADDY and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for your personal, non-commercial use. You may not copy, modify, distribute, or create derivative works without our prior written consent.
Third-Party Services & Links
The Services rely on and may link to third parties, including our telehealth partner, partner pharmacies, payment processors, and other vendors. We are not responsible for the content, policies, or practices of third parties. Your use of a third party’s service may be governed by that party’s own terms, such as our telehealth partner’s Telehealth Consent.
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any result will be achieved through their use. No advice or information obtained from the Services creates any warranty not expressly stated here.
Limitation of Liability
To the fullest extent permitted by law, ZADDY and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to ZADDY in the three months preceding the event giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless ZADDY and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
Dispute Resolution & Arbitration
Please read this section carefully. Except where prohibited by law, you and ZADDY agree to resolve any dispute relating to the Services through binding individual arbitration rather than in court, and you waive any right to participate in a class action. You may opt out of arbitration by notifying us in writing within 30 days of first accepting these Terms.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, except where federal law or the arbitration provision above applies.
Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted to this page, and the “Last Updated” date reflects the most recent revision. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
